I. General Terms and Conditions of Sale
1 – Basic Provisions
(1) The following General Terms and Conditions of Sale apply to all contracts that you enter into with us as the seller (LUCIONE) through the website lucione-clothing.com. Unless otherwise agreed, we object to the inclusion of any of your own terms and conditions, should you use them.
(2) For the purposes of the following provisions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or independent professional activity. An entrepreneur is any natural or legal person, or a legally capable partnership, who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
2 – Conclusion of the Contract
(1) The subject matter of the contract is the sale of goods.
(2) As soon as the relevant product is listed on our website, we make a binding offer to conclude a contract under the terms specified in the product description.
(3) The contract is concluded through the online shopping cart system as follows:
The products you wish to purchase are placed in the “Shopping Cart”. You can access the “Cart” and make changes at any time using the corresponding button in the navigation bar.
After accessing the “Checkout” page and entering your personal details, as well as your payment and shipping information, all order details will be displayed again on the order review page.
If you use an instant payment system (e.g., PayPal / PayPal Express, Amazon Payments, Postpay, or Sofort) as your payment method, you will be redirected either to the order review page in our online store or first to the website of the relevant instant payment provider.
If you are redirected to the relevant instant payment system, you will make your selection or enter your details there. You will then be redirected back to our online store to the order review page.
Before submitting your order, you have the opportunity to review all the information again, make changes (including by using your Internet browser’s “Back” function), or cancel the purchase.
By submitting your order using the “Buy” button, you declare your legally binding acceptance of the offer, thereby concluding the contract.
(4) Order processing and the transmission of all information required to conclude the contract are carried out by email, partly through automated processes. You must therefore ensure that the email address you have provided to us is correct, that the receipt of emails is technically possible, and that emails are not blocked by SPAM filters.
3 – Right of Retention and Retention of Title
(1) You may exercise a right of retention only insofar as your claim arises from the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.
4 – Warranty

(1) French law applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence (principle of favorability).
(2) The provisions of the United Nations Convention on Contracts for the International Sale of Goods are expressly excluded.
